一般信息

分配给民事直接日程部门的所有案件都会收到分配通知。直接日程案件中的法律和动议以及单方申请由分配到的部门审理。所有其他案件中的法律和动议以及单方申请,包括非法占有者,由511部门负责审理。

动议

在任何情况下,如要向法院提出动议,一方必须:

  • 向相关部门预约听证会日期、
  • 向法院提交动议,并 
  • 将诉讼送达至其他当事人。

当事人必须按照法律要求发出听证会通知。《加州民事诉讼法》第1005和1010条及以下规定适用于大多数动议。有关非法占有者和其他民事案件的更多要求,请参阅下文。

单方申请

在任何情况下,如要向法院提出单方申请,一方必须:

  • 向相关部门预约听证会日期(对于需要举行听证会的申请),
  • 向法院提交动议,并
  • 按照法律要求发出听证会通知。

如何预约听证会日期

民事直接日程部门

如需了解直接日程部门关于法律和动议以及单方申请的听证日期和时间表,请访问电子法院公共入口网站 (eCourt Public Portal)。您也可以致电联系或发送电子邮件给该部门。 

驱逐(非法占有者)和其他民事案件

驱逐(非法占有者)和未分配给直接日程部门的案件由511部门管理。 

  1. 登录电子法院公共入口网站
  2. ,选择“Court Reservations”(法院预约)
  3. 选择“Make a Reservation”(预约)
  4. 阅读《日程用户协议》并选择“I Agree”(本人同意)
  5. 输入您的案件编号,然后选择“Submit”(提交)
  6. 填写必填栏位
  7. 选择“Continue“(继续)
  8. 从日程中选择日期/时间
  9. 输入合同信息
  10. 输入卡信息
  11. 选择“Submit Reservation”(提交预约)

预约号和信息将通过电子邮件发送给您进行确认。

511部门法律和动议时间表:周一和周二上午9:30、周三下午1:30

511部门的动议听证会可能在507、511、512、514或519部门举行,这些部门位于Hayward Hall of Justice, 24405 Amador Street, Hayward。

511部门的单方时间表:周一至周四上午9:15

非法占有者案件注意事项

  • 可能适用于较短的通知期限。 《加州民事诉讼法》第1167.5、1170.7、1170.8条及其他规定为非法占有者案件中的部分动议设定了较短的通知期限。

  • 可以向任何接受民事诉讼的法院提交暂缓驱逐申请:

- René C. Davidson法院 (Oakland),以及

Hayward司法厅 (Hayward)。

 法院会在不举行听证会的情况下对这些申请作出裁决。

暂定裁决

Other Important Information

In every case, to present a motion to the court, a party must:

  • reserve a hearing date with the applicable department,
  • file the motion with the court, and 
  • serve the other parties.  

A party must give notice of the hearing as required by law.  California Code of Civil Procedure Sections 1005 and 1010 et seq. apply to most motions.  See below for additional requirements for unlawful detainers and other civil cases.

In every case, to present an ex parte application to the court, a party must:

  1. reserve a hearing date with the applicable department (for applications that require a hearing.)  Ex parte reservations shall be obtained from the courtroom. They cannot be obtained via the portal.
  2. file the motion with the court, and
  3. give notice of the hearing date as required by law.

California Rules of Court 3.1200 et seq. apply to ex parte applications. See below for additional requirements for unlawful detainers and other civil cases.

Civil Direct Calendar Departments

For information about a direct calendar department’s hearing dates and schedules for law and motion and ex parte applications, go to the eCourt Public Portal . You may also call or email the department.  

Evictions (Unlawful Detainers) and Other Civil Cases

Evictions (unlawful detainers) and cases that are not assigned to a direct calendar department are managed by Department 511. 

  1. Log into eCourt Public Portal
  2. Select "Court Reservations"
  3. Select "Make a Reservation"
  4. Read Calendar User Agreement and select "I Agree"
  5. Enter your Case Number and select "Submit"
  6. Complete the Required Fields
  7. Select "Continue"
  8. Select a Date/Time from the Calendar
  9. Enter Contract Information
  10. Enter Card Information
  11. Select "Submit Reservation"

A reservation number and information will be provided, and a confirmation email is sent.

Dept. 511 Law & Motion Schedule:  Monday and Tuesday at 9:30 a.m. and Wednesdays at 1:30 p.m.

Dept. 511 Ex Parte Schedule: Monday and Tuesday at 9:15 a.m. and Wednesday at 1:30 p.m.

  • Shorter Notice Periods May Apply. California Code of Civil Procedure Sections 1167.5, 1170.7, 1170.8, and other statutes set shorter notice periods for some motions in unlawful detainer cases.

  • Applications to Stay Evictions can be filed at any court location that accepts civil filings:

  • René C. Davidson Courthouse (Oakland), and
  • Hayward Hall of Justice (Hayward).

 The court decides these applications without a hearing.
